2003 r53 "help"

Hello there, I'm new to the site and wanted to introduce myself. I'm new to Mini's, but I've been a car enthusiast all of my life. I just picked up a 2003 R53, and I am in love with it. I bought it as a project car for myself and I wish I would've gotten one a Long time ago. The R53 is great, I runs excellent, when it runs. So I have some questions?? It has performance mods added to it. From what I can tell when I got it, it has a:
17% SC Pulley,
2% Damper Crank Pulley
DDWorks Intake
I don't believe it has a header from what I can tell, but the exhaust is not stock. The exhaust runs a straight pipe to one muffler on the left side of the car?? Not sure, sounds good though.
I'm also not sure if it has a Cam, seams like it does??
I've added and changed:
MSD Ignition
Brisk Plugs
8MM Wires
New fuel pump
New fuel filter
Alta intercooler Deflector
So my question is?? I'm having a problem from time to time with my EML light?? I randomly comes on. No specific time, just randomly, then I turn the car off and turn it back on and I'm fine??? Also my check engine light is on as well as my Traction light?? I want these problems to go away.. My car is also hesitant at times, like its "jerky"!!! I've done some reading and research and I feel as if I need a TUNE. I'm really leaning towards ByteTronics and Mynes?? Can anyone tell me if this is the way to go? Any information would help tremendously????

First, have you plugged into your OBDII and pulled any faults present in the system?

I also have the problems you have. Unfortunately my eml light problem is a bad wiring harness. One day I will get to replacing that. Like Pelican said though, you need to pull some codes. The eml light isn't from just one problem.

Definitely could be wiring harness related. There is also a plug to the EML motor that can come loose. Also check the crank pulley and belt. Let us know if this helps!

Checked the codes and it reading a bad downstream O2 sensor, I replaced it and I'm still getting that code. I believe the cars ecm has been tuned and has lost its tune, is this possible??

It already has a super damper crank pulley. Is there any signs that you can tell me to check for regarding the crank pulley and belt? Also I'm curious about this plug to the elm motor and where it is located, I would like to check into that also?? Thank you guys👍🏻

You cleared the code after replacing whatever code was there and a new code or the same code came back? What is the P code that is coming up?
