Quick update: Today Pacific Coast Hwy in Malibu was closed in both directions due to a traffic accident involving a fatality.

Livin' on the Left Coast.......

NM Power Module removed, Dinan Elite installed. 30.4 miles driven, mostly highway. Car feels a lot smoother, power delivery seems more linear. I will update once I am able to log more miles.

The waiting is the hard part. But my understanding is, based on Einstein and the space/time continuum, once you install your Elite your car is gonna go soooo fast that you will be able to go backwards in time and regain the waiting period.

I was going to test it out but then I learned that if you go back in time you have to make all the same mistakes you made last time around, and I've been there and done that.

According to Way mine just went to UPSl. I've got a Vbox, the need for speed, and a science background. I'll see definitively what's up with this thing though I can't compare it to any other tune.

What about the legislation, in USA................you have the right to upgrade your engine with that kind of system ??
I ask because in France, it's strictly forbidden to do that and in case of serious accident, your insurance won't cover you

There was a law passed a while ago that protects dealers from saying mods caused damages. ITs called the Magnuson-Moss Warranty Act - https://en.wikipedia.org/wiki/Magnus...s_Warranty_Act

Basically, dealers cant say that an aftermarket exhaust caused a transmission failure, aftermarket rims caused a radio to break, etc...

Now, technically they could say these "chips" caused an engine failure but the great thing about these systems, you can unplug them before any type of service/warranty work!

He is talking about insurance covering liability if you get into an accident, not MINI refusing to cover engine damage from the modifications. Insurance companies can probably deny claims if they have language to that effect in the policy. Different can of worms.

That is an interpretation of the Act.
The basis of the Magnuson-Moss Warranty Act, is that the manufacturer can't force you to buy OEM repair parts.
Nor have your vehicle maintenance serviced at the dealer.
As in, you need to buy Mini Cooper oil and filter to keep your warranty in effect.
This has forced dealers to not being able to void warranties from using say a Fram oil filter, but if proven that the Fram oil
filter failed, your engine warranty is denied.

But it has been known that manufacturers are capable of logging changes made to the car.

Interesting. Im not really sure here in Minnesota. That might be more of a state by state or insurance company decision. I "dont" think there is a federal law about that.

Very interesting question.

In America, liability must be established in court. There is no law that says because a car is modified there is a legal problem if there is an accident.

Liability is based on "fault." If it could be shown that, becasue of a modification to the car an accident was caused or the accident was worse becasue of the mod, there might be increased liability.

Insurance companies that provide risk insurance in the event an insured is found liable for damages do often have language buried deeply in their policies that give all sorts of ways out of paying claims.

But the underlying principle is that modifications, de facto, do not void warranties or cause automatic liability or void insurance. Cause and effect must be litigated in such instances.

Another interesting consideration would be type of tuning mod. If the ECU/DME is internally changed (reprogrammed) then a manufacturer or a court could find that the person who did the modification messed with the internal engine management programming (actually altered the program) whereas a plug in box that "tricks" the DME isn't altering the engine management software. Fine point of difference. But, lets say a car suddenly accelerates and it is claimed that an ECU flash messed up the drive-by-wire software program. Whereas a plug in box that tricks a car into thinking more boost is needed to hit unaltered internal ECU/DME parameters..... glad I ain't a lawyer.

Life is not without risk. Putting on a tune of any kind should be done with a caveat emptor approach. You pays your money and you takes your chances.

Just got an email from ECS informing me that my Elite will not be shipping until the 6th of Decembuary.
