Agreed, sounds like nice deal. Seller was very responsive and honest. I'm not pursuing further, so if it helps anyone here's some additional info:

Hyper Blue, roof in body color, black leatherette interior. Not a factory JCW. Has Cockpit chrono, chrome line interior, interior surfaces painted in exterior color, sunroof, xenons, foglights, OBC, HK sound, more.
CA car until 2018 when owner moved it to LA. "Front fascia" was replaced after running over an animal. Recent service, including replaced power steering under recall, motor mounts, oil changed in trans and supercharger. Windshield has crack from a rock hit. Interior is said to be like new.
Worth pursuing if you are looking.

2006 R52 JCW 85K miles. $3500 Mechanic special(?) Could be, depending on what it needs. But it's an autotragic transmission.

The auto 1st gen R52 "JCW" is interesting as I don't think they were ever available in the US , even dealer installed. Pretty sure the issue was the JCW engine/tune in combo with the auto transmission not being certified for US emissions.
The VIN decoder doesn't list the options for a factory JCW or an LSD, but from the pics it looks like it has a lot of JCW options though like the 210hp kit and badges, shift light, strut tower bar, real JCW brakes (not R56 replicas), JCW 18" wheels, and possibly a JCW carbon hood scoop. I wonder if it also has the JCW suspension.
Still might be a good buy depending on what's wrong with it and on price negotiations if you don't drive a stick, or you are looking for a fun commuter, JCW parts, or a manual conversion project

From what I remember, the only way to have a “JCW” automatic would be to buy a Cooper S auto and a dealer installed JCW kit, but I seem to remember that (most) dealers would not install the JCW kit on the automatic due to warranty issues aka MINIUSA would not back the warranty of the JCW kit since that part is not “supposed” to be on an automatic.
Like you mentioned, I also remember the software / emissions regulations reason being given.
Theoretically, everything should work except that I don’t think it is possible to have an Automatic and LSD.
