Nice move about not settling the medical claim until the car is fixed, I'd keep playing that angle up just so you still have it available whether or not you choose to pursue it.
Keep us posted, very glad to see they're already getting the car fixed, I had a VERY slow shop one fix a VERY minor (cosmetic only) damage to my truck's front fender. Took them weeks to do a 2 day job.

The state that I live in doesn't recognize diminished value.
But from what I understand , you do have to sell your car to show an actual loss in trade in value due to collision damage & subsequent repairs. They can't compensate you untill you actually suffer a loss.
But that may cost you money because of the cars loss in value from depreciation as well. That stinks because you were not looking to sell your car you were just minding your own business when someone ran into you.

I just sent in a diminished value questionaire to the company of the persons car that recently rolled into the side of my MINI. I'll let you know what the reply is. At no time have they suggested that I must sell the car to collect.

Yeah... sign nothing. Most insurances have a statute of limitations, as it were, on medical claims. For example, in my case my chiro is covered under my own medpay and as long as I experienced problems within the first year after the accident, the coverage is good for 3 years from the initiation of the claim. That is to say that insurance will cover any problems that might crop up. I don't know how it works if you're NOT dealing with medpay, but I would imagine that the system is similar -- until you sign something releasing the insurance company for any further responsibility.
If you're having medical problems, this would probably be the time when you might want to talk to a lawyer so that you are completely aware of what you're signing and ALL of its ramifications.

Thats just the way it was explained to me by an insurance friend of mine.
They can't compensate for a future loss.
You have to suffer a loss first.

Finished?
Picked up the Cooper from the body shop yesterday. Finally! Car is still not repaired to my satisfaction. The boot latch had bubbles in the paint and the rest of the car looked great. They removed the latch cover and replaced it with a chrome one while they repaint the new one. The left and right plastic panels in the boot have some marks on them where they were flexed during the crash, they were not cracked but discolored. Allstate drive in adjusters are Shysters! The adjuster only gave me an appearance allowance 100 bucks each. the new parts are about 480 a piece. I called the adjuster handling my claim and told her I was not happy and wanted them replaced. She was calling the body shop. We shall see what happens on Monday! I will say Orr's body shop has been good to work with, the paint finish is excellent. I am going on a Mini drive tomorrow to the air force museum in Dayton Ohio should be great! Will post pics later...
