R52 2008 conv. top wearing through frame when top is in down position

2008 conv. top wearing through frame when top is in down position
Our 2008 conv. top is wearing through at the point where (when the top is down) the frame ends. It appears as though an extra bit of nylon fabric was sewn at the factory on this tip (to provide an extra layer of fabric)... but now the frame is just starting to wear through that extra bit of fabric. Does anyone know if that would be under warranty? I have 28,000 miles on the car. Thanks for any help.

Here is the area I was referring to. You might have to double click to enlarge it. It is back by the rear windows. I don't believe it is actually a part of the top.
I found out this morning that it is covered under the 4year/50k warranty.
I have a question... for those who have an 08 cooper convertible.... does this area look the same on your car when the top is down?
I looked at another Mini today that was parked next to mine and their top was down... and the area in question looked alittle different than mine. Theirs seemed to 1) not have the wear and 2) their piece was more bent downward ..mine seems to be parallel with the ground.
Can anyone tell me if they have this problem ?

top wearing?
The area in the picture seams to have the shield in a bent position and the corner of the top seams out of adjustment also..like something got in there when the top was going up or down. I have the first cabrio and the top and shield in those areas look as new... Good luck at the dealership..
