Are dealer "upcharges" legal on new cars in California?

In the past, some dealers of new cars would drive cars (don't know about Mini's) to put mileage on, so they could then sell them as used. They would then charge above MSRP.

Is this legal in California, or any other State?

Some California MINI dealers are adding mark-ups on new cars.

I don't know the answer to your question, but who, in their right mind would pay over MSRP on a Demo?

I thought that a car had to have been titled to be considered used.

Some dealers do add on charges though, call them market adjustments or simply glom on marked up add-ons to make more profit.

The S in MSRP is suggested; the dealer doesn't have to adhere to it regardless of whether the car is used or new.

True, unless the manufacturer has set guidelines about that as several have (certainly not BMW/MINI tho). In those cases you see the used or dealer add-ons work around.

It's called MSuggestedRP for a reason.
The bad press from a delaer allegedly driving a car to call it used would be beyond bad. It's probably an urban legend.

The car was the Datsun "Z", when it first came out. The dealer was in the
San Fernando Valley. He was very well known for "gimicks". I saw, and drove the cars myself, and they still had the plastic coverings over the seats. It was around the late sixties or early seventies.
