The side scuttles look correct for the JCW vehicles; they appear to be the standard chrome JCW scuttles. I also bought my JCW Clubman used; somewhere along the line (prior to my ownership; perhaps the vehicle was even ordered this way...?) the standard side scuttles had been replaced with the black grille side scuttles from the JCW accessory line.
The easiest and most definitive way to ascertain whether this is a factory JCW vehicle is, as "RockyRoad" suggested, by using the VIN. Digits 4-7 in the VIN comprise the vehicle code; if they are "MM91," "MM92," or "MM93" (depending on the country), it's a genuine, born-at-the-factory JCW Clubman!
As far as the missing JCW badge goes, that's annoying -- but easily rectified if you want. I'm certain you can get a replacement at your MINI dealer by coughing up a few bucks, then put it on yourself; those sorts of vehicle trim pieces are usually adhesive-backed ("peel-n-stick") items.

Yes a new JCW badge can be purchaced at the dealer, and it is a simple peel and stick affair as timfitz63 said. However it is quite pricey the last time I looked it was $94.00 per badge!! a little rediculas if you ask me. I wanted one for on my dash until I saw the price.
That is one nice looking Clubby, and buying used is my prefered method of buying a car so dont feel bad because you payed less. I bought both of my MINI's pre-owned(with minor problems) and they depritiated nicely in somone elses garage leaving them to flip all that negitive equity.
