Just got a reply from the Service Manager at the dealership. Here is what he said.
Hi Jim,
Congrats on the new Mini. They are a blast aren't they!? The new Cooper "S" do not come with Jack's or Lug Wrench's because the vehicle's are outfitted with runflat tires. No need for the Jack's and Wrench's so the manufacture does not supply them. They used to when they had conventional tires, hence the use of the same foam holder.
So looks like I won't be getting any tools.

Picked up my 09 MCCS on Thursday. No Jack (or spare) - MA claimed the new "S" models with Runflats do not come with them anymore. I did get a couple of the tools (screwdriver, etc...) so I guess I should just be happy I got them. Will eventually get rid of the runflats, so will look for a spare donut (was told the Honda Civic donut is same bolt pattern).

My wife took delivery of her MCCS at the end of Oct and it only had a screw driver and tow hook. Talked to the MA and he is getting the missing parts together for us. He said they knew some MCS were missing the tools but ours was the first Clubman. I should be taking delivery of another Clubman next Saturday and I will check to see what is in this one.

I think you all have more accommodating dealers in this regard. I was reading the manual this weekend and it even says the tools are only for cars without run flats. Not worded exactly the way American English would but I get the meaning. Think it said something along the lines of cars equipped with space save spare get the tools. So i think this will be an uphill battle if I push it. As this is a lease and I am not going to be changing to non run flats i am just not going to worry about it.

My guess is the dealers are eating the costs. If you don't like what your MA is saying, give the manager a shot to keep you happy. If he/she states the same thing that the jack/bar are not included in S models, it's time to purchase the jack/bar yourself (albeit grudgingly). Ask the manager, since they will not provide, could they sell them to you at cost. You could always wait and hope that MINI will change direction and include them, but by then you may have needed the Jack/bar once or twice. Good luck!!!

I have the cooper. One other item included in my tool kit (missing in the picture) other than the handle for lowering the spare tire was an extra key for the wheel lock.

Thanks for this thread. I called my MA and asked about it and he said to contact the SA (service advisor) and she would hook me up with a kit. When I spoke to the SA, she said all I had to do was come in and fill out some paperwork. She didn't say anything about the build error. However, when I talked the the PA (parts advisor) to pick up the stuff, he said what I got was all that was included in the bulletin.
No hassles at my dealership. The didn't call it an error, but happily gave me one when I asked.

I picked up our new 09 MSC earlier this month. Knowing... thanks to this list... that some new cars were being delivered without a jack I had a look in the rear as part of my prepurchase inspection and found no jack present. I mentioned this to the MA who immediately said they would order one and mail it to me. I am still waiting for to to arrive but am confident I will receive one. There are many reasons why any driver may need to jack. Mini should include them in all cars.. runflats or not.

If you are out on some desert highways like I have been, maybe 100 miles from anywhere that can fix a tire, iffy cell coverage, and a very long wait for a tow truck... you'll fix your flat if you have the tools to do so.
A jack is basic equipment. Not including one is a safety issue as far as I'm concerned.

it seems to me that not having a jack is a ( MAJOR RIPOFF) because the buyers of these minis paid for a jack, whether or not: their cars came with runflats.
