2007-2009 Cooper S differences

I've had a classic Mini (1971 model) in the past and only recently discovered this great website. I'm now in the market for a 2nd gen Cooper S. Have two questions.

One, what's the scoop on the premature clutch failure issue I've seen some internet squawking about? Is this an unusual occurrence? If it is a real issue and not overblown, is there a factory service bulletin or recall for this?

Two, I noticed a significant EPA MPG rating difference between the 2009 and the 2007-2008 models. (Might be confusing this). I thought the engine was direct injected and turbocharged and, with the exception of the JCW model, was the same powerplant in 2007, 2008 and 2009 Cooper S models. Were any changes made to the factory Cooper S engine during those model years?

Appreciate any info that can clear up my confusion. Thanks!

One: I don't think the clutch in the MINI is any worse than other makes. It may be a piece of crap clutch, but most of us have had no problems.

Two: Engine is the same until MY 2011. There's been slight tweaks like the timing chain tensioner. The 2007 had a fully closed hood scoop which cause it to melt. My 2008 has about half the holes open and hasn't melted.

Otherwise the 2009 just has DSC standard, higher mph speedo and a possibly better built interior? I remember people saying it rattled a little less. Maybe I'm mistaken.

As for the MPG, it may have just been a change in the way the EPA measured fuel economy.

The EPA changed the way MPG's were calculated for 2008 and later model years. 2007 will have different ratings than later vehicles.

My 2007 has the partly opened scoop and it still warped a little not noticeably unless you look really closely.
