Please go to http://www.nhtsa.dot.gov/ to record this issue on file. Mine still has not been resolved - even had my passengers wiggle around in the seat with the light still on. Unfortunately, it doesn't happen all the time .

My 2008 Clubman had the same problem, as did one other here in the Salt Lake City, UT area. Mini of Murray told me it was a "faulty parts batch" on the shift interlock assembly. I could tell the solenoid in the shifter handle was not engeaging.
My car had the "Amber Gear Icon" over 35 times before I decided to take it in for repairs. From what I am seeing and hearing on this, MINI USA should be doing a recall, as a large percentage of the automatics are having this problem. If you have the "Amber Gear Icon" ie: faulty shift lock on your '08 and newer automatic, insist on the entire shift linkage asesembly to be replaced, as this is what MINI is doing on the cars that exhibit this failure. MINI is very aware of this minor problem. I am surprised that MIINI USA does not have a TSB out on this item. It's a minor repair, but as others have said a key saftey factor, especially if you have children in your car. Good luck with it.....

I agree that was a quick turn around that is why I am curious if they started this process even before I mentioned lemon law. We are hoping for Wednesday for pick up but we will not know for sure until Monday. The weather is getting pretty nasty here getting snow and next week sleet and freezing rain not a good thing to be driving in.

BTW I just filed for Lemon Law on my '08 MCS with MINI USA (unrelated to the transmission problem) and they are buying back my car but for some reason not offering me a new replacement instead.I have a seperate thread on that.

Thanks Otra and no I do not have snow tires and we don't plan on buying any this year we will wing it and sees what happens. My MA assures me that it will handle well, we will see if we get two feet probably if that happened my MINI would be buried.
