woah, HiredGuns - don't panic on us now! MINI has been listening. I have no reason not to trust my contact at MINIUSA that a fix will be here shortly. There's a good chance your MCS won't even have the Yo-Yo. If you're concerned (and it looks like you are), you CAN drive your MCS before signing the paperwork, to ensure yours is spot-on.

The only problem with waiting the car arrives and test driving is that the yoyo doesnt always happen upon delivery (it didnt on mine at least). And if you take delivery, Mini will simply feed you the "its a characteristic of the car" line and claim the "fix" will be released "next month."

From what I understand from reading through these pages, the actual cause of the yo-yo is software, not controlling the bypass valve properly. However, by fitting a stronger spring into the valve body, you can effectively "fix" the problem via hardware. The software issue still remains but the hardware "fix" overrides it.
I pick up my MCS next week but hopefully it won't have a noticable yo-yo. The demo we drove had it slightly, but I didn't really notice it while my wife did.
My fix? Press the accelerator harder.

Ryephile, Woah is right. All I been doing since I made the decision to buy a mcs is dream, & labor over the color like I’ve never labored before on a car color. I sold my 911 because I just fell head over heals in love with this car. Mini has had what seems to be over a year to remedy this and so far things continue to continue. Not good in my book. Let me put it this way I want this car! But the last thing I need in today’s automotive world is a car with problems that the factory can’t fix or, just won’t? Time for me to make some serious decisions. I will contact my dealer, also as many wrench heads I can think of to try and keep with my choice.

You must not want this car as bad as you say you do. The Yo-yo is an annoyance to most. I've had it for a year now and I'd say, I would still buy the car. The "Stumble" for me was more than any annoyance and I would say I wouldn't have bought the car because of that. It is fixed now and I believe if they release a fix for the Yo-yo that it will work. Your right at the end of the tunnel at your delivery date so I certainly wouldn't worry about it.

I would also add that after reading over all these pages, my impression is that the severe yo-yo is actually pretty rare. Many report a mild yo-yo, which can be annoying, but almost everyone says that it goes away after the car warms up. I have had my MCS for a little over a week, and driven it about 700 miles. I have noticed the yo-yo exactly twice, and each time it was mild and happened only for a fraction of a second.
I would also add that Ryan started working on this in late December. That was pretty close to the time the stumble fix came out. The yo-yo may have been a problem before that, but people weren't nearly as worried about it as they were about the stumble. Assuming that the yo-yo became a priority to someone at MINI around December, and assuming that a fix will be here by 1 May, that's a mere 5 months (with holidays thrown in) to troubleshoot, do development and testing, and go through all the approval red tape. It takes a good deal of time to engineer and test good code--indeed, time MINI should have put in a while back, but perhaps they are learning their lessons. In my opinion, they have moved lightening fast for something that is just "annoying" in Ryan's words--and he has a very severe case. No doubt, MINI could have and should have handled the whole thing better. But this car is so great--I think you might regret changing your mind over something small that might be fixed by the time your car is delivered.

I took delivery of my '04 MCS last October. I was praying it didn't have the "stumble"...knowing it might have the Yo-Yo. I really wanted to drive the MCS and would wait for the updates to cure all ills!
As it turned out, my car was updated with the latest software version (v.36) at the VPC in NJ right after it came off the boat. This happened about a month before v.36 made it to the dealers. No stumble!
It turned out I did have the yo-yo and it has been a minor annoyance (typical of the '04s vs. some particulary strong "bucking" '03s). However, I've performed Ryephix #1 with the only negative result being a very slight loss of MPG. This is tiding me over until v.38 is available.
The best part is that the Ryephix #1 only cost me 10 minutes of time and one zip-tie. But I assure you I will be one of the first in line at my dealer for the v.38 upgrade!

I think you are probably right about that, and I am not questioning your decision in any way. Clearly many of the MINI dealers do not treat their customers well. But in my experience, this is true of every other car company as well. ALL of them produce products that may have some flaws. ALL of them rely on the dealers to interface with their customers. ALL of them have had problems that have made their customers feel the way you do. You could go by what Consumer Reports and what JD Power say about quality and treatment of customers. But even then you could be unlucky and get a bad car, or a bad dealer. No car or car company is immune. The Lemon law is a truly beautiful thing. I say let your delivered automobile prove its "lemon-ness" to you before you reject it on the testimony of others' anecdotal experience. This protection allows you to buy a car based on what you think is going to fit your needs the best and not be immensely worried that you can never get your money back if it ends up biting you.
That said, I applaud your tenacity in going through the lemon law, I feel bad for you that MINI let you down, and I hope that your replacement, be it MINI or other, is good to you.

I havent heard of many car companies that allow their dealers to "ban" their customers from bringing their car into service at the dealership (as at least two people in this thread have had happened to them). Seems to be a BMW thing.

Once you go into Lemon phase (allowing the manufacturer to perform final fixes on the car) you are dealing directly with Mini HQ/BMW. I was dealing with them long before this stage also, as the dealership was obviously not equipped to deal with the software problems. In fact I started dealing with Mini NJ within a few weeks of owning the car. That was more than a year ago now. I live in FL.
Having been through this experience I would not only say that my MCS is a Lemon, but the BMW corporation is also a LEMON.
BMW knew they had serious problems with this yoyo issue before we purchased our cars. If you got a good one, that's fine but many of us didn't. BMW have blamed it on modifications we have done to our cars, bad gas, bad driving and any other straw they can clutch on to, and then turned their back on us by passing it off as a "characteristic".
Sure lemon cars exist in any make, but I seriously doubt that Infiniti or Lexus would put a customer through what I've been through with BMW, knowing that they sold me a bad car.
The cars may be fixed one day, but it's the BMW corporation that is the bigger Lemon here, and fixing that will be a lot more difficult.

Interesting,
I got rid of my 03 MCS last June because of the yoyo syndrome. And it still continues :evil: I figured BMW wouldn't fix it as long as the cars sold and people put up with it. I'm happier than ever with my decision to sell. I don't miss the car at all, especially the yoyo

I'm not sure this is the right thread to post this on, but ... close enough...
BMW of Hawaii installed V37 in my 2003 MCS (Lucy) on Saturday. Lucy didn't have any problems with yo-yo that I noticed, but she did have the stumble when shifting from neutral to first, and the colder she was, the worse it was. She also had a problem with starting on the first turnover when she was cold too (cold in Hawaii being in the low 60's).
I am happy to report that V37 seems to have fixed the stumble problem. Temp was in the low 60s this morning when I fired her up, and no problems there either. Of course, the only way to really assess this as a "fix" is to see how it works long-term, but so far, I am pleased (knock on wood!!!). V37 also seems to have eliminated most of the delay in acceleration. Lucy feels very peppy, quick, and responsive now.
With the old software, I was also constantly having problems matching RPMs when shifting. It is MUCH easier now and shifting is much smoother.

BMW of Hawaii installed V37 in my 2003 MCS (Lucy) on Saturday. Lucy didn't have any problems with yo-yo that I noticed, but she did have the stumble when shifting from neutral to first, and the colder she was, the worse it was. She also had a problem with starting on the first turnover when she was cold too (cold in Hawaii being in the low 60's).

regarding ryephix #1is there a down side to leaving the "the plastic linkage from the vacuum actuator" attached and just zip tying it in place? or is this a must remove from the butterfly arm lever...?
Curious- as I currently have just such a setup in place w/ryephix #1 and was looking for feedback... The Yo-Yo has disappeared and a smile is slowly creeping a cross my face the more I motor, but I just have this lingering question as to whether this i an issue?
