MINI Failure

'07 MCS, 47,500. Fourth (4) time, same issue over a 90 day period. Car dies while driving. No warning, no ability to 'limp' it safely off the road. It'll crank but no spark, engine turning over but not catching. Dangerous, unsafe, very concerned.

So far, the diagnostics are about 1" thick of paperwork, 5 weeks in the shop. Engineering calls / online with MINI / BMW experts. 70+ hours mechanics time trying to figure it out. Like chasing a ghost, never pinpointing the problem / cause. Temporary fix, 2-300 miles later same issue..

So far entire ignition system replaced (too many parts to list), sensors, engine wiring harnesses, etc. Yes, checked HPFP and all related parts, all tests ok according to dealer.

Everything under extended warranty so no cost out of pocket. Peace of mind, consumer protection being challenged, vehicle / road safety very compromised.

So, what rights do I have to present to MINI / BMW to remedy the problem? Trade in? New car? Walk away from brand? Seek legal representation?

Confidence in the brand is shot, nerves are wracked, challenges of towing, etc. are becoming ridiculous. No car for work/travel/enjoyment. Dealer is reluctant to offer resolution / $$ solution yet. Band-aid fixes so far, they want to try to continue to diagnose and fix.

I do believe that the dealer, Schomp, is trying their best to figure it out but at what point do you give up? My fear is driving down highway or mountain pass, car dies and...

What would you do? (originally $32k, loaded)

I'd trade it, demand they take it off your hands. I wouldn't feel safe driving it if I were you. I understand that your brand confidence is shot, maybe they have a used BMW or something on the lot. Or an R53.

Dealer/Mini should give you a deal on another car since it's a safety issue and they can get it fixed right or guarantee your safety. God forbid something happens to you due to this ongoing malfunction they're on the hook. Additionally, I don't know who behind the extended warranty but it's got to be costing some big $$$$$. It may be cheaper for them to cut you a great deal on a different car.
