Midland Gearbox Problem or Something Else?

2004 mini cooper non S manual transmission manufactured 05/04. Has had gearbox replaced once before while under warranty about 4 years ago. Problem showed up with the wife yesterday jumping out of 2nd and 3rd gear. Problem went away on 2nd but she has to hold it in 3rd or it will pop out of gear. Is this another gearbox gone/ going bad? could it be low transmission fluid level? Also shifts fine otherwise no grinding or anything like that. If it is bad where is the best place to get a re-manufactured transmission? I was looking at BMS Direct LTD in the UK but I believe shipping would be a killer. Any advise or help pointing me in the right direction would be much appreciated.

I'm just interested at this issue, don't think i can be any helpful.

But, any mod to shifting?
could it be problem of a seiged clutch cable? release bearing?
Or is it just driver's timing on shifting / releasing clutch?
Anyone?

Thanks for taking the time to look GTA_R53 but its the gearbox. We made it a week longer but 1st gear is about gone now as well as 2nd. No mods just stock. Time to buy another gearbox.

popping out of 2nd and 3rd is the most common failure with the midlands trans. We see it all the time.
If you need a Midlands trans let us know.
