FRM Warranty Replacement

FRM Warranty Replacement
I received from BMW north America an extension of the FRM to 10 years or 100k. Previously, we received a water manifold extension, and at 26K (what I would consider a new car) experieinced the infamous "death rattle" the N14 motor is infamous for. The timing section etc. was replaced by indy shop prior to the Skeen vs BMW North America class action suit. Half of the 1700 cost was refunded which I still consider lousy for 26k on the car. I learned later that others received 100% but mine happened early in lawsuit period. Sorry, I went down a bunny trail a bit....
Now that FRM has extended warranty it will be covered for 100k or 10 years, whichever comes first. My car is a 2010, R56 "S". It is a third car less frequently used an now has 56k so, the 10 years should happen first. I DO expect the FRM to go out as so many others have. Question is, if FRM has not blown prior to additional warranty period expiring, would it be possible to take to dealer with complaint of windows malfunctioning for replacement? Repair is 725ish. Since we have experienced all other extended warranty issues can we have FRM R/Rd' prior to warranty expiration by dealer?
