MINI SOFTWARE UPGRADES?

My CVT Mini also lurches & bucks as if it was a manual driven by a 1st time stick shift driver, but not when stopped at a light. Only happens when speeding up or slowing down.
Making a long story short: dealer repeatedly tries to fix problem with upgraded software. So far, no good.
QUESTION: Imagine 100 computers all running the same software. Ninty-nine are OK but one keeps crashing. Would you try new s/w on the manfunctioning machine or look for hardware trouble?
Why would most Minis run OK on the original s/w but some need an "improved" version??? It defies logic.

Interesting...I have been racing my CVT for the past 6 months. Both my partner and I have CVT's. Without any problems. Did your car fall under the recall for the CVT? Which was because the factory had used the wrong tranny fluid.

It is now one month since the third time I brought my new Mini limping back to Mini of Manhattan and they say they're still awaiting a new software version that'll cure the bucking & slipping.
Their current line is that putting low-viscosity oil into the CVT at the factory did no damage at all; the car's problems are all computer related and the tranny fluid screw-up is merely coincidental. Sounds like weasel talk to me, but I'm no expert.
This afternoon I'll probably get around to filling out the eight-page form needed to start the NYS Lemon Law process. I hate paperwork.
