Poor Sick Mini/In Limbo?

It is now one month since the third time I brought my new Mini limping back to Mini of Manhattan and they say they're still awaiting a new software version that'll cure the bucking & slipping.
Their current line is that putting low-viscosity oil into the CVT at the factory did no damage at all; the car's problems are all computer related and the tranny fluid screw-up is merely coincidental. Sounds like weasel talk to me, but I'm no expert.
Does anyone out there know what the new software is gonna do that the previous software didn't?
This afternoon I'll probably get around to filling out the eight-page form needed to start the NYS Lemon Law process. I hate paperwork.
